Your first appearance, explained

People arrive at a first appearance expecting a trial and leave confused because almost nothing happened. That is by design. The first appearance is an administrative step, and knowing that in advance saves a great deal of anxiety.

THE BASICS

What actually happens that day

No evidence is called. No witnesses attend. Nothing is decided about guilt.

The purpose is procedural

The court confirms you know the charges, confirms whether you have counsel, and sets the next step. The Crown provides its initial disclosure package or confirms when it will. If you do not yet have a lawyer, the matter is adjourned so you can retain one, and asking for that adjournment is entirely normal.

You often do not need to be there

Counsel can ordinarily appear on your behalf for routine appearances using a designation, which means you do not lose a day of work or drive two hours for a five minute matter. You will be told clearly which dates genuinely require your attendance.

Disclosure is the real event

Disclosure is the evidence the Crown intends to rely on: the synopsis, the officer notes, witness statements, video, audio, photographs, certificates and expert material. It is the file. Everything that follows, including whether the case can be resolved and whether it should be tried, comes out of reading it properly.

Then a Crown pre trial

Once disclosure has been reviewed, counsel meets with the Crown to discuss the case, the issues, and whether it can be resolved. A judicial pre trial follows in matters that are heading toward trial. This is the stage where most cases are actually decided.

IN PRACTICE

Practical points for the day

If you are attending in person, this is what to expect.

Arrive early, allow time for security screening, and bring your release paperwork with you.
Dress as you would for a job interview. It is noticed, quietly, by everyone in the room.
Courtrooms run lists, so expect to wait. Your matter may be called at any point in the morning.
Turn your phone off rather than to silent, and do not record anything at any point.
If you do not have counsel yet, duty counsel can assist you that day with the adjournment.
Take note of your next date before you leave, and confirm what is expected by then.

Frequently asked questions

Do I have to attend my first appearance?
Usually not, if you have counsel who can appear for you. Failing to attend without counsel or a designation results in a warrant.
Will I be sentenced at my first appearance?
No. Nothing about guilt or sentence happens then, and it should not, because disclosure has not yet been reviewed.
What if I have not received disclosure?
The matter is adjourned. Repeated failures to disclose are pursued rather than accepted, because the delay is not yours to absorb.
Can I plead guilty at the first appearance?
It is possible and it is almost always a mistake. A plea entered before disclosure has been read forfeits every issue that might have existed.
How many appearances will there be?
Frequently several before the matter resolves or is set for trial. Most are procedural, and most can be covered by counsel.
