Charged in a domestic matter

Of all criminal charges, domestic allegations cause the most immediate disruption. You may be out of your home the same night, unable to speak to your partner, and unsure whether you can see your children. Here is how these files actually work.

THE BASICS

Why everything happens so fast at the start

Domestic files are handled through a dedicated stream with policies designed around risk, and those policies operate before any evidence has been tested.

Charges are laid, not negotiated

Where police attend a domestic call and find reasonable grounds, a charge follows. The complainant is not asked whether they want one, and telling police afterward that they would rather not proceed does not end it. Only the Crown can withdraw a charge.

The conditions arrive first

A no contact condition, a condition not to attend the residence, and often a firearms condition take effect immediately on release. That is why people find themselves collecting belongings under police escort within hours of an argument, long before anyone has assessed the strength of the allegation.

Contact is the trap

If the complainant contacts you, answering is still a breach, because the condition binds you and not them. This is the single most common way people turn a defensible domestic file into a much worse one. If contact needs to be restored, it is restored by varying the condition.

How most of these files end

A large proportion resolve without a trial and without a criminal record, through withdrawal, a peace bond under section 810, or a diversion or counselling programme where Crown policy permits it. Reaching that outcome depends on how the file is prepared and how it is presented, and on the material gathered early.

IN PRACTICE

What to do, and what to avoid

The first week matters more than any other part of a domestic file.

Read every condition and follow all of them exactly, including the ones that feel unjust.
Do not contact the complainant, directly or through anyone else, and do not respond if they contact you.
Preserve messages, call logs, photographs and anything else from before and after the incident. Do not delete anything.
Arrange somewhere stable to live, because a fixed address supports both a variation and a resolution.
If there are children, get advice on how the criminal conditions interact with any family court order before you do anything.
Speak to counsel about a variation immediately rather than waiting for the case to conclude.

Frequently asked questions

My partner wants to drop the charges. Can they?
No. Once a charge is laid, only the Crown can withdraw it. The complainant’s position is relevant to resolution but it is not determinative.
Can I go home?
Not while a condition prohibits it. A variation is the correct route and it is frequently available more quickly than people expect.
What about my children?
Where the complainant is a co parent, contact conditions often affect the children indirectly. Carve outs for parenting time are commonly negotiated and can be coordinated with family court.
Will I get a criminal record?
Not necessarily. Peace bonds and withdrawals leave no record at all, and they are the most common outcomes in these files.
Should I write to the complainant to explain?
No. It breaches your conditions, it becomes evidence, and it will damage your case far more than any explanation could help it.
